These terms set out the baseline rights and obligations that apply between you and VIVA EDUCATION PTE. LTD. (UEN 202448391R, "VIVA", "we") when you use viveedu.com and the associated advisory channels (email, telephone, WhatsApp). Browsing or using the website is taken as acceptance of these terms.

Section 1Scope and acceptance

These Terms of Service ("Terms") apply to:

  • Every visitor to https://viveedu.com and its subdomains;
  • Every prospective client who contacts VIVA by email, telephone, WhatsApp, or website form;
  • Every individual who interacts with VIVA before the formal Tutoring Service Agreement is executed.

By accessing the website or sending any enquiry to VIVA, you confirm that you have read, understood and accepted these Terms in full. If you do not agree, please stop using the website and stop contacting VIVA.

Section 2Acceptable use of the website

You agree not to do any of the following:

  1. Mass-scrape the site using automated scripts (including crawlers, bots, headless browsers);
  2. Decompile, reverse-engineer, disassemble, or attempt to bypass any access control on the site;
  3. Use any of the site's content to train any machine-learning model (AI training scraping) without VIVA's written authorisation;
  4. Communicate with VIVA under a false, impersonated or fraudulent identity;
  5. Upload or transmit viruses, trojans, ransomware or other malicious code;
  6. Conduct any denial-of-service, traffic-overload or other activity that degrades the experience for other users;
  7. Engage in any activity that breaches Singapore law or the law of the jurisdiction you are in.

Any breach of this section entitles VIVA to terminate your access immediately and reserves all rights to legal action (including potential criminal liability under Singapore's Computer Misuse Act 1993).

Section 3Content copyright and IP

All content on this website — including text, images, the logo, brand identity, colour system, typography choices, layout, teaching methodology, programme directory, original case studies, video and code — is the intellectual property of VIVA EDUCATION PTE. LTD. and is protected by Singapore's Copyright Act 2021 and applicable international copyright conventions.

Unless separately authorised in writing, you must not:

  • Copy, republish, redistribute, adapt or re-publish any of this content;
  • Remove copyright notices, trade marks or attribution;
  • Use the content for any commercial purpose.

Permitted use: you may quote the website's content for personal study, research and citation in line with the fair dealing exceptions of Singapore's Copyright Act, provided you attribute the source ("Source: viveedu.com") and do not use the material commercially.

Third-party brands (e.g. Kaplan, PSB, Amity, SIM and other awarding-university logos) remain the property of their respective owners; the references here are factual descriptions of partnership or programme listings.

Section 4Enquiries are not a contract — the binding service agreement is separate

Please pay particular attention to the following:

  1. Website enquiries do not form a contract. No exchange through a form, email or WhatsApp constitutes a binding service commitment by VIVA or a contract between you and VIVA.
  2. The binding contract is the Tutoring Service Agreement. The service relationship only commences after both parties sign the formal Tutoring Service Agreement (bilingual EN/ZH versions, one copy each) and you have made the initial payment.
  3. Verbal statements are not binding. Any verbal or electronic statement made by VIVA staff, tutors or partners is for guidance only; if it conflicts with the written contract, the written contract prevails.
  4. Indicative pricing. Any prices, packages or promotions displayed on this site are indicative of the moment shown; VIVA reserves the right to adjust them at any time before the contract is signed. The final price is the Quotation.

Section 5User-submitted content

If you send VIVA any text, files or images ("user-submitted content") through the contact form, email attachments or WhatsApp:

  • You warrant that you have the lawful right to share the content and that the submission does not infringe any third party's intellectual property, privacy or other rights;
  • You grant VIVA a limited, non-transferable non-exclusive licence to use the content solely as needed to evaluate your tutoring needs and to respond to the enquiry;
  • VIVA will not use such content for public marketing, case studies or third-party model training without your consent.

Section 6Third-party links

The website may link to awarding universities, partner PEIs, regulators (CPE, ESG, PDPC etc.), payment providers and other external resources. These links are provided for convenience only; VIVA does not endorse the content, policy or security posture of any third-party website. You access third-party sites at your own risk.

Any information on a third-party site — in particular university accreditation, programme detail and entry requirements — is subject to the official announcements of that university or the relevant regulator (CPE, SkillsFuture Singapore etc.). References on this site are convenience pointers only and do not guarantee admission or accreditation outcomes for any specific programme.

Section 7Disclaimer

The website is provided "as is" and "as available". VIVA makes reasonable efforts to keep the content accurate and current, but does not provide any express or implied warranty of:

  • Absolute accuracy, completeness or timeliness;
  • Continuous, uninterrupted, error-free availability;
  • Freedom from viruses or malicious components;
  • Any specific academic outcome (see Disclaimer).

VIVA's tutoring is learning support: we explain concepts, coach writing structure and review drafts pre-submission. Final academic outcomes depend on the student's own effort, and VIVA does not guarantee any specific grade, degree classification or admission result.

Section 8Limitation of liability

To the maximum extent permitted by applicable law:

  1. VIVA is not liable for any indirect, incidental, special, punitive or consequential loss arising from your use of, or inability to use, the website (including loss of profit, goodwill or data);
  2. VIVA is not directly liable for losses caused by interruptions, failures or data breaches of third-party services (including Cloudflare, Stripe, WhatsApp and Google), although we will help you pursue the third-party provider where reasonable;
  3. In all circumstances VIVA's aggregate liability to you is capped at SGD 100 (for visitors who have not signed a Tutoring Service Agreement). For contracted students, the cap is whatever the signed Tutoring Service Agreement specifies.

These limitations do not apply to loss caused by VIVA's fraud, wilful misconduct or gross negligence — VIVA bears whatever liability is required by applicable law in those cases.

Section 9Force majeure

VIVA is not in breach for service interruption, delay or failure caused by acts of God, war, terrorism, pandemic, network outage, third-party service failures, government order, strike or other event beyond VIVA's reasonable control. VIVA will make reasonable efforts to restore service promptly after the event ends and to notify users.

Section 10Governing law and dispute resolution

These Terms are governed by, and construed in accordance with, the laws of the Republic of Singapore, without regard to its conflict-of-laws rules.

Any dispute arising from these Terms or use of the website should be resolved by the parties in good faith. If that fails, the parties will proceed in the following order:

  1. Mediation: submit the dispute to the Singapore International Mediation Centre (SIMC) under its mediation rules in force at the time;
  2. Litigation: if mediation fails, the matter is subject to the exclusive jurisdiction of the courts of the Republic of Singapore.

The dispute-resolution choice above is substantive and cannot be unilaterally varied.

Section 11Amendments

VIVA reserves the right to amend these Terms from time to time. Material amendments (affecting liability caps, dispute resolution, copyright scope etc.) will be announced at least 14 days in advance in a prominent place on the site and notified by email to clients with records on file. Amended Terms take effect on the announced date and apply to all visitors thereafter; continued use of the website is taken as acceptance.

The "last updated" date at the top of this page marks the latest version. Historical versions are available from [email protected] on request.

Section 12Entire terms / severability / contact

Entire terms. These Terms, together with the Privacy Policy, PDPA Notice, Cookie Policy, Disclaimer, and (where signed) the Tutoring Service Agreement, constitute the entire agreement between you and VIVA on website use and advisory contact.

Severability. If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect.
